Copyright, Licensing and Content Usage Policy

All photographs, videos, captions, text, graphics, and multimedia content published, distributed, or licensed by Nepal Photo Library are protected under the Copyright Act, 2059 (2002) of Nepal.

Unless otherwise agreed in writing, copyright and intellectual property rights remain the exclusive property of Nepal Photo Library and/or the respective photographer, videographer, or content creator.

No person or organization may reproduce, distribute, publish, broadcast, modify, store, or commercially exploit Nepal Photo Library content without prior written authorization.

Nepal Photo Library grants limited licenses for specific agreed purposes only.

A license does not transfer ownership of copyright.

Any use beyond the agreed scope, duration, platform, territory, or publication shall require a separate written agreement and additional licensing fees.

The following activities are strictly prohibited:

• Copying photographs from websites, social media platforms, or third-party publications.
• Downloading, screenshotting, screen-recording, or republishing content.
• Removing or altering metadata, credits, captions, or copyright notices.
• Editing, manipulating, or creating derivative works without permission.
• Using content for commercial, political, advertising, or promotional purposes without a valid license.
• Training artificial intelligence systems or machine learning models using Nepal Photo Library content without written consent.

Providing credit alone does not constitute permission to use copyrighted material.

Where required under a licensing agreement, content must be credited as:

Failure to provide proper credit may constitute a breach of licensing terms.

Nepal Photo Library adheres to the Code of Journalistic Ethics issued by Press Council Nepal.

Photographs and videos intended for editorial use shall not be altered in a manner that misrepresents facts, events, persons, or circumstances.

Captions and contextual information must accurately reflect the content depicted.

Nepal Photo Library respects privacy rights recognized under the Constitution of Nepal and applicable laws. Special consideration shall be given when photographing:

• Children
• Victims of crime
• Disaster victims
• Vulnerable persons
• Medical patients

Content may be withheld, edited, or removed where publication may cause undue harm or violate legal rights.

Any unauthorized use of Nepal Photo Library content may result in:

• Formal cease-and-desist notices.
• Claims for licensing fees and damages.
• Removal requests to websites and social media platforms.
• Legal proceedings under the Copyright Act, 2059 and other applicable laws of Nepal.

Nepal Photo Library reserves the right to pursue all legal remedies available under Nepalese and international copyright law.

These policies shall be governed by and interpreted in accordance with the laws of Nepal.

Any dispute arising from the use of Nepal Photo Library content shall be subject to the jurisdiction of the courts of Kathmandu, Nepal.
